Catholic politicians and Catholic judges

Ed Whelan over at Bench Memos comments on E.J. Dionne's op-ed where he states there is no difference between the role of faith for Catholic politicians and Catholic judges and wonders why the bishops did not call out Justice Kennedy for his opinion in Casey like they did with Sen Kerry and other pro-abortion Catholic politicians. Mr Whelan comments:

Surely American bishops can be expected to understand and to explain the elementary point that judges, unlike legislators, are bound to determine the meaning of the law, not to engage in policymaking. The fact that American bishops have not criticized Scalia and Thomas for failing to adopt a “pro-life” reading of the Constitution amply testifies to the point.
